Former Special Counsel Jack Smith allegedly tracked the private communications and phone calls of nearly a dozen Republican Senators during his investigation into the January 6, 2021, Capitol riots. This investigation was conducted under the FBI case named “Arctic Frost.”
According to Fox News Digital, Smith and his team allegedly tracked the calls of GOP Senators: Lindsey Graham (South Carolina), Marsha Blackburn (Tennessee), Ron Johnson (Wisconsin), Josh Hawley (Missouri), Cynthia Lummis (Wyoming), Bill Hagerty (Tennessee), Dan Sullivan (Alaska), Tommy Tuberville (Alabama), and GOP Representative Mike Kelly (Pennsylvania).

A document obtained by Fox News Digital, titled “CAST Assistance” and dated September 27, 2023, shows that the FBI’s Cellular Analysis Survey Team (CAST) conducted preliminary analysis on the lawmakers’ toll records. The names of FBI agents involved were redacted.
An FBI official confirmed that Smith and his team could see which phone numbers the lawmakers called, where the calls originated, and where they were received. These calls were likely related to the vote to certify the 2020 election. The records were collected in 2023 after Smith’s team issued subpoenas to major telephone providers.
The “Arctic Frost” case was opened inside the FBI on April 13, 2022, and Smith was appointed as special counsel to take over the probe in November 2022.
FBI Deputy Director Dan Bongino briefed the lawmakers on Monday at Capitol Hill after the discovery of Smith’s surveillance. Bongino called it a disgrace that the FBI had been weaponized to track U.S. lawmakers’ private communications for political purposes, and emphasized that under their leadership, the FBI will never again be used as a political weapon against the American people.
FBI Director Kash Patel added, “We recently uncovered proof that phone records of U.S. lawmakers were seized for political purposes. That abuse of power ends now. Under my leadership, the FBI will deliver truth and accountability, and never again be weaponized against the American people.”

The discovery of these records came after an oversight request by Senator Chuck Grassley (R-Iowa). Patel and Bongino personally directed an additional review of the Arctic Frost case. Because the case is classified as “prohibited,” the review involved extra steps to ensure transparency and accountability.
Smith, after months of investigation, had charged former President Donald Trump in U.S. District Court for Washington, D.C., regarding the 2020 election. After Trump became president, Smith requested the case be dismissed, which was approved by Judge Tanya Chutkan.
